The receiver in bankruptcy in proceedings under reference number act XIX GUp 531/21 announces the competition procedure in the single-hand sale procedure for the sale of a BMW 116i passenger car, man. 2005, mileage 157859 km, VIN number WBAUF11080PT76874 for a price not lower than PLN 10,600.00 (say: ten thousand six hundred zlotys 00/100).
The condition for participation in the competition procedure is the payment of a bid bond in the amount of PLN 1,000.00 to the bank account of the bankruptcy estate at Santander Bank Polska S.A. with the number: 56 1090 2590 0000 0001 4816 3676 with the annotation "Bid bond in the tender competition - ref. no. Act. XIX GUp 531/21 ”at the latest by the last day of the deadline for submitting tenders, the actual deadline for crediting the amount of the above-mentioned bid security to the above-mentioned bank account.
Tenders should be submitted by the deadline of August 12, 2021 to the following address: Biuro Syndka, ul. Marszałkowska 9/15 lok. 53, 00-626 Warszawa (the decisive factor is the date of the actual receipt of the offer by the receiver, not the date of posting).
The offer, under the pain of its rejection, must:
1. be placed in a closed envelope, which should be placed in a second, larger envelope. Each of these envelopes should be addressed to the above-mentioned the receiver with the reference number of files XIX GUp 531/21 and the note: "DO NOT OPEN - OFFER in BMW bankruptcy proceedings",
2.include the exact name of the person submitting the offer by indicating his name or surname, KRS number or PESEL number, correspondence address, telephone number and e-mail address,
3. contain a proof of payment of the bid security to the indicated bank account.
4.include the buyer's obligation to cover all fees related to the conclusion of the sales contract, including taxes and fees, as well as VAT and PCC, if any.
5. contain a declaration that the tenderer is familiar with the factual and legal status of the movable property and does not raise any objections in this respect.
The bids will be opened and examined on August 13, 2021 at 10:00 at the trustee's office at ul. Marszałkowska 9/15 lok. 53 in Warsaw.
If more than one offer is received, the receiver will conclude a contract with the highest bidder.
The buyer whose offer is selected is obliged to pay the entire offered price before signing the sales contract.
In addition, the buyer will make a declaration in the sales contract that he waives claims under the warranty for physical and legal defects against the trustee in bankruptcy, provided that such defects are revealed.
The tenderer whose offer is selected is required to conclude a sales contract by August 31, 2021 at the latest.
Set-off of the Buyer's claim against the Fallen with the claim for the purchase price is unacceptable. The sale of the movable property covered by this proceeding has the effects of an enforcement sale.
