The Court Bailiff at the District Court in Chełm, Arkadiusz Bolek, announces to the public that on August 31, 2022 at 10:00 at the address: Zakątek 10h, 22-100 Chełm, will be held in the manner set out in Art. 867 of the Code of Civil Procedure First movable property auction: KIA SORENTO passenger car, prod. 2012, 150 hp diesel.

The sum of the estimate is PLN 32,200.00. The price of the call is PLN 24,150.00.

The movable property can be viewed on the day of the auction in the place indicated above, half an hour before the start of the auction. The price of the call is 3/4 of the estimated value.

The entrant is obliged to submit a warranty in the amount of one-tenth of the sum of the estimate (i.e. the amount of PLN 3,220.00), no later than on the day preceding the tender (the warranty may be paid in cash at the office or to the bank account of the bailiff's office - indicated in the header).

The warranty does not apply if the sum of the estimate is lower than five thousand zlotys. Pursuant to Art. 871. the buyer is obliged to pay the purchase price immediately after receiving the confirmation. However, when the price exceeds five hundred zlotys, the buyer's obligation is limited to submitting one fifth of the price immediately, but not less than five hundred zlotys, with the rest being paid by twelve on the following day.

If the buyer has not complied with the conditions of the auction on time, he loses the warranty, and the effects of the adjudication expire. From the buyer released from the obligation to pay the warranty, who has not fulfilled the obligation to pay the price or its part within the prescribed period, the bailiff will collect the sum corresponding to one tenth of the sum of the estimate. The warranty of the bidder who acquired the movable property is included in the price, the remaining warranty will be returned to the account from which it was received or to the other account indicated in writing.

In order to collect the purchased movable property, the price must be paid immediately after the end of the auction. The following persons may not participate in the tender (as a bidder): the debtor, the bailiff, their spouses, children, parents and siblings, persons present at the auction in an official capacity and the bidder who did not comply with the conditions of the previous auction. The presence of the debtor and the caretaker of the seized movable property is obligatory.

The power of attorney to participate in the tender should be confirmed by a document with an officially certified signature, unless it is a power of attorney granted to an attorney or legal advisor.

The movable property which is the subject of this auction can be viewed on the day and place of the auction, half an hour before the start of the auction.

Before proceeding to the auction, you can familiarize yourself with the estimate of the movable property available for inspection at the bailiff's office (address in the header). Acquisition of movable property by auction is subject to tax on civil law transactions in accordance with the Act of September 9, 2000 on tax on civil law transactions (Journal of Laws 2017.1150, i.e. of June 2017).

The rights of third parties will not be an obstacle to conducting the auction and the award to the buyer without reservations, if these persons do not submit a proof prior to the start of the tender that they have brought an action for exemption from execution of movable property and obtained a decision suspending enforcement in this respect.
