Jacek Toporek's bankruptcy trustee in the proceedings with reference number IX GUp 387/21 announces the competition procedure in the single-source sale for the sale of a motor vehicle Volkswagen Passat, prod. 2003, LKR 70FW reg.No.
Tenders should be submitted by the deadline of March 10, 2022 to the following address: Biuro Receiver Jacek Toporek in bankruptcy, ul. Marszałkowska 9/15 lok. 53, 00-626 Warsaw (the decisive factor is the date of the actual receipt of the offer by the receiver, not the date of posting).
The offer, under the pain of its rejection, must:
1. be placed in a closed envelope, addressed to the above-mentioned the receiver, along with the file reference number IX GUp 387/21 and the note: "DO NOT OPEN - OFFER in bankruptcy proceedings - VW PASSAT",
2.contain the exact identification of the person submitting the offer by indicating his name or surname, KRS number or PESEL number, correspondence address, telephone number and e-mail address,
3.include the buyer's obligation to pay all fees related to the conclusion of the sales contract, including taxes and fees, as well as VAT and PCC, if any.
4. contain a declaration that the tenderer is familiar with the factual and legal status of the movable property and raises no objections in this respect.
The bids will be opened and recognized on March 11, 2022 at 12:00 at the trustee's office at ul. Marszałkowska 9/15 apartment 53 in Warsaw.
If more than one offer is received, the receiver will conclude a contract with the highest bidder.
The buyer whose offer is selected is obliged to pay the entire offered price before signing the sales contract.
In addition, the buyer will make a declaration in the sales contract that he waives claims under the warranty for physical and legal defects against the trustee in bankruptcy, provided that such defects are revealed.
The tenderer whose offer is selected is required to conclude a sales contract no later than April 1, 2022.
Set-off of the Buyer's claim against the Fallen with the claim for the purchase price is unacceptable. The sale of the movable property covered by this proceeding has the effects of an enforcement sale.
